Three Common Trademark Problems On Social Media

Posted on

When you are dealing with an idea, a brand name, or a new product, a name can mean a lot. One of the first things that you should do is add the name that you plan to use on social media. The next thing that you should do is attempt to get a trademark for the names that you plan to use. If you are just starting up your business and you are hitting some snags in the trademark department, you will need to know a few things about trademarks, social media, and how to maneuver problems. Here are a few problems that you may hit and how to deal with them along with your business lawyer.

Trademarking can't stop use of your legal name

It is not uncommon to find out that someone is trademarking the use of a regular name. Sometimes if a business opens up by using a name, the owners will protect themselves by trademarking the name. This, however, does not mean that you cannot do business or operate on social media under your legal name if it is the same as another person or stores. If you have been hit with a trademark infringement claim for using your legal name, a business lawyer can help you provide documentation to the business to let them know that your name is yours to use.

A word addition can make the difference

An equally common problem that could happen is that you find out that someone is using or has a trademark for the same name as the product that you have elected to use. If you find that another business has come up with a similar name, you can make an addition to your name in order to make sure that you are not entering into a trademark issue. Adding another word to your own product and social media name can mean that there is no trademark issue and that you can register a trademark of your own. Be sure that the products are not too similar so that customers do not confuse your businesses.

Someone else trademarking on social media

Some business owners go the route of trademarking before they get on social media. The problem with doing things this way is that another person can build up a name for themselves or their account using their own brand. If you find that someone else has registered an account on social media in the name of your new trademark, getting the account from them will not be easy. One of the best things to do is to have your business lawyer contact them with a financial offer to buy the account. Contact a lawyer, like Souders Law Group, for help.
